COURTS 60-second read

Utah’s Kalshi suit triggers federal lawsuit from Washington

Published: 1 min read
An empty federal courtroom with wooden benches & tall windows at dusk.

Utah’s own suit, filed 20 October, names Kalshi units & Susquehanna as defendants too.

The hit

The United States & the Commodity Futures Trading Commission have sued the State of Utah, trying to block its attorney general from enforcing state gambling law against Kalshi. The federal complaint, filed 26 October in Utah district court, says Utah’s own 20 October lawsuit against Kalshi entities & Susquehanna intrudes on exclusive federal jurisdiction over derivatives markets.

Why it matters

If Utah wins, states could start treating CFTC-approved event contracts as illegal sports bets, splitting prediction markets state by state. A federal win keeps Kalshi & rivals trading nationally under one regulator instead of fifty different gambling codes. The outcome shapes whether exchanges can keep selling sports-linked contracts anywhere in the US.

The record

Utah lawsuit filed 20 October 2026, Third Judicial District Court, Salt Lake County (Utah AG)
Utah defendants named Kalshi Inc., KalshiEX LLC, Kalshi Klear Inc., Kalshi Klear LLC, Kalshi Trading LLC, Susquehanna International Group LLP, Susquehanna Government Products LLLP
Federal lawsuit filed 26 October 2026, US District Court for Utah (US & CFTC)
CFTC’s Kalshi approval 3 November 2020, Order of Designation (CFTC)
CFTC sports-league integrity deals MOUs signed with MLB, NHL & NBA in 2026 (CFTC)

What happens next

Watch the Utah district court docket, case 2:26-cv-01055, for the state’s response & any early injunction ruling on whether Kalshi can keep operating in Utah.
