DraftKings tells Congress it does not ‘target’ problem gamblers
FanDuel gave lawmakers a similar denial in October, after a Bryce Harper video sparked lawmakers’ letter to FanDuel.
The hit
DraftKings told Congress it does not target problem gamblers or use AI to identify bettors likely to lose & push them to wager more. The six-page letter, sent Friday & obtained by InGame, responds to an inquiry from Sen. Richard Blumenthal & Reps. Paul Tonko & Valerie Foushee into DraftKings’ VIP & rewards programmes.
Why it matters
Lawmakers had asked whether DraftKings uses AI ‘to track and target gamblers’ with perks & promotions, & sought the average loss/gain of rewards members. DraftKings, like FanDuel, declined to share financial specifics, leaving Congress with assurances rather than data.
The record
| Original inquiry | Oct. 22, covering VIP & rewards programmes (lawmakers) |
|---|---|
| VIP tier size | Under 1% of customers in Diamond & Onyx tiers (DraftKings) |
| Celebrity outreach | Does not rely on athlete or celebrity content as an incentive; aware of one Cameo sent to a customer (DraftKings) |
| Tool usage | Nearly half of customers used ‘My Stat Sheet’ within a year of its March 2024 launch (DraftKings) |
What happens next
A Capitol Hill hearing on college-campus sports gambling is scheduled for Wednesday. The SAFE Bet Act, a proposal to bring legal sports betting under federal regulation, has yet to gain traction.
