CFTC pauses Novig & ProphetX micro contracts
Neither contract has traded yet as both exchanges await the regulator’s verdict.
The hit
The Commodity Futures Trading Commission has paused self-certified contracts from two prediction market exchanges, according to Legal Sports Report. Novig’s bets on who scores a basketball game’s first points, & ProphetX’s scorigami contracts, have both been flagged as potentially unlawful under the Commodity Exchange Act.
Why it matters
Neither product has ever traded, so no bettor has been affected yet, but the move signals the CFTC is getting stricter on sports event contracts leagues call manipulable. Both exchanges must now justify their markets to the regulator or drop them. It also matters for bettors watching whether prediction markets keep offering prop-style bets sportsbooks have been told to restrict.
The record
| Novig contract flagged | First-points-scored basketball micro contracts (CFTC) |
|---|---|
| ProphetX contract flagged | Scorigami contracts, ruled not a swap under the CEA (CFTC) |
| ProphetX response | Voluntarily deferred listing, provided extra analysis to the CFTC |
| New Jersey bill | S2160 micro-bet ban, stalled since March committee vote |
| CFTC rule proposal | Oct 9: new swap definition covering sports, politics, culture & weather contracts |
What happens next
Watch whether Novig & ProphetX satisfy the CFTC’s compliance demands, or whether the contracts are withdrawn altogether. The agency’s Oct 9 rule proposal on swap definitions is also one to track.
