Kalshi CEO & COO face felony counts as Utah turns criminal
Utah separately sued Kalshi last week to block sports, election & politics trading in the state.
The hit
Utah has filed criminal charges against prediction market operator Kalshi & its co-founders, chief executive Tarek Mansour & chief operating officer Luana Lopes Lara, according to the Associated Press. The felony charges include 13 counts of violating Utah’s gambling ban & another count over profiting from illegal activity. It comes months after a federal judge rejected Kalshi’s bid to block Utah from enforcing its anti-gambling laws against the platform.
Why it matters
This marks a shift from civil enforcement to criminal prosecution of a major prediction market & named executives. Legal analyst Daniel Wallach says Utah’s move could be a bellwether for how other states treat Kalshi & Polymarket after Nevada’s appellate win. For the industry, it raises the personal & corporate stakes in a fight likely headed to the Supreme Court.
The record
| Utah AG statement | Derek Brown says Kalshi operated in Utah ‘despite’ a federal ruling backing state law |
|---|---|
| Kalshi response | Calls the charges ‘crazy overreach’, says Utah is ‘playing politics’ |
| Arizona precedent | First state to file criminal charges against Kalshi; case now on hold |
| Utah civil suit | Filed last week to stop Kalshi trading on sports, elections & politics in the state |
| States involved | Litigation spread across roughly 20 states, per the Associated Press |
What happens next
Watch Kalshi’s response in court, which it says will mirror its fight in Arizona, plus Utah’s separate civil suit seeking to block trading & recover profits made in the state.
