Sixth Circuit sides with Ohio & Tennessee against Kalshi

The 3-0 ruling should make it easier for Ohio, Tennessee & Kentucky to ban Kalshi’s sports contracts.

Kalshi lost again in federal court Friday. The Sixth Circuit became the second appeals court to rule that states can apply their gambling laws to Kalshi’s sports event contracts, siding unanimously with Tennessee & Ohio, according to InGame.

Why it matters

The ruling deepens a split between circuits, with the Sixth & Ninth against Kalshi & the Third in its favour. That split makes Supreme Court review more likely & in the meantime it should make it easier for Ohio, Tennessee & Kentucky to ban Kalshi’s sports contracts within their borders.
