Kalshi loses Nevada rehearing, has 90 days for Supreme Court bid
Kalshi warned in its petition it now faces civil & criminal liability despite CFTC regulation.
The hit
The Ninth Circuit unanimously denied Kalshi’s petition for a panel rehearing & rehearing en banc on Wednesday, with no judge requesting a full-court vote, according to CDC Gaming. Kalshi now has 90 days to petition the U.S. Supreme Court for review.
Why it matters
Nevada’s ban on Kalshi’s sports-event contracts stays in force & the firm loses its injunction shield against state enforcement. Kalshi’s lawyer, Paul Clement, may try to delay Supreme Court review until the CFTC’s rulemaking on event-contract jurisdiction is finalised.
The record
| Rehearing denied | Ninth Circuit, unanimous |
|---|---|
| Deadline to act | 90 days to file for Supreme Court certiorari |
| CFTC rulemaking | Notice of Proposed Rulemaking & Interim Final Rule issued 9 October |
| Public comment deadline | 18 November, on CFTC’s proposed rule |
| Kalshi’s petition | 78 pages |
