Lula’s betting ban faces Supreme Court test after re-election
Congress has until 25 November to consider the measure, with a possible 60-day extension.
The hit
Brazil’s Superior Electoral Court confirmed Lula’s re-election on Sunday, with just over 4.3 million votes separating him from Flávio Bolsonaro. The result reopens the fight over Lula’s gambling ban, Provisional Measure 1,394, now headed for rulings in the Supreme Court & the National Congress.
Why it matters
The Supreme Court rules on whether the measure is constitutional, while Bolsonaro’s party, the PL, holds the largest blocs in both houses of Congress.
The record
| Lula’s vote share | almost 52% to just over 48% for Bolsonaro (Superior Electoral Court) |
|---|---|
| Operator losses | about R$1.2bn in revenue lost after a 30-day-plus forced shutdown |
| Licence fees paid | R$30m per five-year concession plus R$5m in reserves, per operator |
| Government tax loss | over R$400m in lost tax revenue, including GGR tax & corporate levies |
| Licence expiry | permits lapsed on 25 October |
What happens next
Watch for Supreme Court rapporteur Luiz Fux’s ruling on the measure’s constitutionality & whether Congress installs its joint committee.
