COURTS 60-second read

New York takes Kalshi to court over unanswered subpoenas

Published: 1 min read

The move follows a July lawsuit reportedly seeking at least $36bn in damages from Kalshi over alleged unlicensed gambling.

The hit

New York’s gaming regulator has gone to court to force Kalshi to comply with subpoenas, saying the prediction market operator has left them largely unanswered since summer. The Commission filed a verified petition with the New York State Supreme Court in Manhattan, accusing Kalshi of having ‘flatly refused to produce any documents’ in response to certain requests.

Why it matters

The Commission wants records on Kalshi’s sports-event contracts, under-21 users & advertising that it says calls those products wagers or bets. Each category feeds its wider case: whether Kalshi is running an unlicensed betting operation subject to the state’s Racing Law, or a financial exchange outside its reach. A federal-versus-state question over who regulates these contracts sits behind the dispute.

The record

Subpoenas issued 31 July 2026, with a return date of 14 August (New York State Gaming Commission)
Petition filed Logged by the Manhattan court on 22 October 2026
July injunction bid Kalshi’s request denied by Judge Analisa Torres on 7 July 2026
AG lawsuit damages sought $36,000,000,000.00 minimum, pending accounting (Decrypt)
Utah lawsuit Seeks up to $61.2m in fees allegedly collected by Kalshi

What happens next

No hearing date or ruling has been reported. Ohio’s gaming licensees face an October 30 deadline to cut ties with prediction market operators, among the most aggressive state actions alongside New York’s.
