NFL backs states over Trump’s regulator in Kalshi fight
Kalshi says it has partnered with MLB & the NHL & cannot be policed by 50 separate states.
The hit
The NFL has filed a Supreme Court brief against the CFTC, Trump’s own regulator, asking justices to let states police prediction markets such as Kalshi & Polymarket, according to coincentral.com. The league says the CFTC ignored its concerns over game integrity & let people under 21 place bets. The CFTC says it reached out to the NFL since its rulemaking began & called the league’s approach ‘unfortunate’. Kalshi says it tried to work with the NFL & cannot be regulated by 50 different states.
Why it matters
The case could decide who polices sports-style prediction contracts: a single federal regulator or state gambling regulators. The NFL argues some contracts can be swayed by one player’s effort or an official’s call. 39 states & Washington DC call the standoff a ‘national turf war’ & want the Supreme Court to settle it.
The record
| States & DC backing state regulation | 39 states + Washington DC, in a joint Supreme Court brief |
|---|---|
| Ex-CFTC chair backing states | Gary Gensler, filed brief arguing Congress never meant CFTC to override state gambling law |
| Law co-author backing states | Former senator Chris Dodd, co-wrote the CFTC’s governing statute |
| NFL betting share cited | More than half of one Sunday’s total prediction-market volume (NFL filing) |
What happens next
Watch for Kalshi’s response to New Jersey’s filing, due 9 November, & for whether the Supreme Court agrees to hear the case at all.
