DraftKings, FanDuel & 7 others face New York AI ad ban
A separate proposal advanced at the same meeting would require operators to flag at-risk bettors & name a staff contact to engage them. Chairman Brian O’Dwyer said he was concerned that a customer restricted by one operator could simply open an account with another licensed sportsbook.
The hit
The New York State Gaming Commission voted to advance a rule barring mobile sportsbooks from using AI to personalise promotions, odds or wager suggestions to individual customers, according to Yogonet. The rule covers operators, affiliates & vendors, & exempts customers who consent & parimutuel horse racing.
Why it matters
For bettors, it means fewer AI-driven nudges steering spending or specific bets. For operators, it limits a marketing tool unless customers opt in.
The record
| Vote | Unanimous advance on Friday (NYSGC) |
|---|---|
| Model rule | Based on New Jersey’s regulation, which does not ban the tech outright |
| Licensed operators affected | 9, including DraftKings, FanDuel, BetMGM, Caesars & Fanatics |
| State tax rate | 51% of gross gaming revenue from mobile wagering |
| Industry tax contribution | Over $1bn a year, per Sports Betting Alliance president Joe Maloney |
What happens next
The revised AI rules go through another public comment round before returning to the Commission for discussion & a possible vote.
