Massachusetts asks every sportsbook if AI targets losing bettors
The probe follows a report alleging DraftKings used AI to target losing customers, which the firm denies.
The hit
The Massachusetts Gaming Commission (MGC) has sent every licensed sportsbook operator in the state more than 70 questions on whether AI tools target bettors who are losing money. Participation is voluntary & responses will be kept confidential, according to the commission’s letter.
Why it matters
The review tests whether operators can explain their own AI systems: why a specific patron got a specific promotion, & whether losses or sudden spikes in betting trigger marketing. Massachusetts already bans AI known to make platforms more addictive. Answers will help shape the MGC’s AI policy across Massachusetts operators.
The record
| Response deadline | 3 November 2026 (Massachusetts Gaming Commission) |
|---|---|
| Trigger | New York Times report alleging DraftKings used AI to target losing customers |
| DraftKings response | Denied wrongdoing to The New York Times |
| Michigan stance | Gaming board ‘reviewing the issues raised’, no DraftKings-specific probe confirmed |
What happens next
MGC chair Jordan Maynard said further action or policy may follow, with any steps “determined by the commission when and if appropriate” once responses are reviewed.
