Ohio warns sportsbooks: help prediction markets, risk your licence

Published: 1 min read
An empty state regulatory hearing room with rows of vacant seats facing a raised panel desk, dusk light through tall windows.

Polymarket has sued Ohio, calling its cease-&-desist letter unconstitutional under the Commerce Clause.

The hit

The Ohio Casino Control Commission has told sports betting & fantasy licensees that providing services to prediction market operators could jeopardise their licences. Interim executive director Andromeda Morrison said licensees supporting “unregulated and unlicensed gaming through prediction markets” risk their suitability, & must confirm compliance by 30 October.

Why it matters

The warning targets firms offering liquidity, market making, integrity monitoring & tech services to prediction markets, not just the platforms themselves. It raises the stakes for any licensed supplier still quietly working with prediction market operators. The notice calls suitability “a continuing obligation of licensure”, giving Ohio room to act against suppliers as well as platforms.

The record

Compliance deadline 30 October (Ohio Casino Control Commission)
Cease-&-desist deadline for 10 firms 16 October (OCCC order covering Underdog, Gemini Titan, Coinbase, Prophet X, Novig, Robinhood, Polymarket, Plus500, Moomoo & Webull)
Polymarket lawsuit filed Southern District of Ohio, 46 pages, argues the cease-&-desist letter violates the Commerce Clause & is preempted by the Commodity Exchange Act
Prior guidance August 2025 (OCCC’s earlier position on prediction markets)

What happens next

Watch for Ohio’s response to Polymarket’s lawsuit & whether the remaining non-compliant operators face new suits, after Governor DeWine reportedly told Attorney General Andy Wilson to begin filing them.
