Tribal & Nevada regulators reject Kalshi’s ‘innovation’ defence

Published: 1 min read
An empty tribal council chamber with a long wooden table & vacant chairs, lit by late afternoon light through tall windows.

IGA executive director Jason Giles says tribes waiving sovereign immunity for Kalshi deals are exposing themselves to future lawsuits.

The hit

Nevada Gaming Control Board chairman Mike Dreitzer says Kalshi’s sports-event contracts are illegal sportsbooks, not innovation, according to CDC Gaming. He spoke alongside Indian Gaming Association executive director Jason Giles on the IGA’s New Normal webinar.

Why it matters

Giles says tribes that signed deals with Kalshi & waived tribal-sovereign immunity are exposing themselves to future lawsuits, calling the activity all illegal. Lawyer Scott Crowell questioned whether tribal-gaming agencies have made suitability determinations on Kalshi & said there are cases on both sides of whether the Commodity Exchange Act preempts state gaming regulations. Nevada has already barred any operator involved in prediction markets from its licensed industry, according to Dreitzer.

The record

Minimum trading age on most prediction markets 18 (CDC Gaming)
Minimum wagering age in most states with legal sports betting 21 (CDC Gaming)
Tribes reportedly partnered with Kalshi 5, including Tunica-Biloxi & Alabama-Quassarte (CDC Gaming)
Nevada’s stance on prediction-market operators any participation bars licensing in state (Dreitzer, NGCB)
Disputed Kalshi announcement October 7 announcement named Alabama-Quassarte among 4 new partners; Chief Samuel Marshall Jr. denies any partnership (CDC Gaming)

What happens next

Watch for court rulings on whether the Commodity Exchange Act preempts the Indian Gaming Regulatory Act, after Crowell said every court that has ruled on the IGRA question so far has held that IGRA governs activity on Indian lands.
