Magistrate recommends Kentucky v Polymarket return to state court
Polymarket had argued its CFTC-regulated status meant the case belonged in federal court.
The hit
A federal magistrate judge has recommended that Kentucky’s lawsuit against Polymarket be sent back to state court, rejecting the platform’s bid to keep the case in federal court. Kentucky’s attorney general, Russell Coleman, alleges Polymarket ran unlicensed sports gambling in the state. The recommendation was issued on 14 October 2026, according to the court filing.
Why it matters
Polymarket wanted a federal judge, arguing its status as a CFTC-regulated contract market gave it a shield against state gambling claims under the federal officer removal doctrine & federal-question jurisdiction. The Commonwealth argued the court lacked subject matter jurisdiction & sought remand.
