Seminole Tribe sues DraftKings over predictions & Pick6
DraftKings says its prediction market follows the Commodity Exchange Act & that Pick6 is not sports betting, according to a company spokesperson.
The hit
The Seminole Tribe has sued DraftKings, its prediction market arm & CEO Jason Robins, alleging both DraftKings Predictions & its Pick6 fantasy game are illegal sports betting in Florida. The suit was filed Thursday in the Seventeenth Judicial Circuit, Broward County, according to InGame.
Why it matters
The tribe runs Florida’s only legal sportsbook, Hard Rock Bet, under a compact that grants it exclusive sports betting rights in the state; wagers count as placed on tribal land because Hard Rock Bet’s servers sit on Seminole land. The tribe argues DraftKings Predictions functions like a sportsbook rather than a prediction market. Other operators, including Kalshi, Polymarket US & Underdog, also run prediction markets in Florida & have not been sued by the tribe.
The record
| Lawsuit filed | Seventeenth Judicial Circuit, Broward County |
|---|---|
| Exclusive rights since | 2021, under Seminole-Florida compact |
| Age limit gap alleged | 18+ on DraftKings Predictions vs 21+ on Hard Rock Bet |
| Prior challenge cited | 2022 ballot initiative backed by DraftKings, failed per complaint |
| Robins investor letter | Cited in complaint on faster predictions losses |
What happens next
Watch for DraftKings’ formal response & whether the tribe seeks an injunction to halt DraftKings Predictions & Pick6 in Florida while the case proceeds.
