Pennsylvania’s skill-game machines face seizure as stay ends
Attorney general Dave Sunday says turning the machines off will not stop prosecution under state gambling law.
The hit
Pennsylvania state police will start seizing skill-game machines from businesses once a 120-day Supreme Court stay expires on 14 October, according to Casino.org. The state’s top court ruled in June that the devices count as illegal slot machines despite their skill element. Attorney general Dave Sunday says switching the machines off will not satisfy the law.
Why it matters
Host businesses, distributors & vendors all face prosecution if machines stay in place past the deadline. The attorney general’s office had estimated roughly 70,000 skill-game machines operating statewide before the ruling, & host businesses also risk losing their liquor licences. Efforts to legalise the games continue in Harrisburg, but Gov. Josh Shapiro’s 52% tax plan failed.
The record
| Supreme Court ruling | Skill games ruled illegal slot machines (Pennsylvania Supreme Court, June 2026) |
|---|---|
| Stay expires | 14 October 2026 |
| Machines at risk | ~70,000 skill-game machines statewide (attorney general’s office estimate) |
| Maximum penalty | 5 years’ imprisonment & $10,000 fine per offence (Crimes Code section 5513) |
| Failed tax proposal | 52% tax on gross terminal revenue (Gov. Josh Shapiro’s 2026 budget) |
What happens next
From the deadline, Pennsylvania State Police can seize machines, proceeds & equipment & pursue liquor licence action against host businesses. Watch Harrisburg for any last-minute legalisation push before enforcement begins.
